1. Agreement to These Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "user") and Pick the Game LLC ("Company," "we," "us," or "our"), a Virginia limited liability company located at 107 E Market St., Leesburg, VA 20176.

By accessing or using our website located at https://www.pickthegame.com, our mobile application Pick the Game, or any related products or services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to use the Services.

2. Purpose of the Services & Non-Gambling Disclaimer

Pick the Game provides tools to organize and manage social football pick pools for friends, family, and coworkers.

Important Disclaimer:

• Pick the Game does not operate, promote, or conduct gambling.
• The Services are provided for entertainment and social purposes only.
• Any entry fees, prizes, or rewards associated with a pool are entirely user-organized and managed outside of Pick the Game.
• We do not collect, hold, distribute, or facilitate real-money wagering.
• Users are solely responsible for ensuring compliance with all applicable laws.

3. Intellectual Property

All content, software, trademarks, logos, designs, and functionality included in the Services are owned by or licensed to Pick the Game LLC and are protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes only.

4. User Accounts

You may be required to register an account to access certain features. You agree to provide accurate information, keep your credentials secure, and accept responsibility for all activity under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Purchases & Payments

Certain features of the Services may require payment.

• All prices are listed in U.S. dollars
• Payments are processed through third-party payment providers
• All purchases are final and non-refundable, except where required by law or in cases of billing error

We reserve the right to change pricing or discontinue paid features at any time.

6. Acceptable Use

You agree not to misuse the Services. Prohibited conduct includes, but is not limited to:

• Illegal or unauthorized use
• Cheating, manipulating results, or exploiting bugs
• Using bots, scripts, or automated systems
• Harassment, abuse, or threats toward other users
• Uploading malicious code or overloading servers
• Attempting unauthorized access to accounts or systems

7. User Content

You may submit content such as usernames, comments, or pool names ("User Content"). You retain ownership of your User Content.

By submitting User Content, you grant us a limited, royalty-free license to use, store, and display such content solely to operate, improve, and promote the Services.

We reserve the right to remove content that violates these Terms.

8. Mobile Application Terms

If you access the Services via our mobile app, you are granted a limited license to use the app on a personal device in accordance with these Terms.

App Store Compliance

• Apple and Google are not responsible for the Services
• Any claims relating to the app must be directed to Pick the Game LLC
• App Store providers are third-party beneficiaries of these Terms

9. Privacy

Your use of the Services is subject to our Privacy Policy. By using the Services, you consent to data processing in the United States.

10. Termination

We may suspend or terminate your access to the Services for violations of these Terms or applicable law.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICK THE GAME LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, IN THE PRECEDING 12 MONTHS.

13. Indemnification

You agree to indemnify and hold harmless Pick the Game LLC from claims arising out of your use of the Services or violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

15. Dispute Resolution

The parties agree to attempt informal resolution before initiating binding arbitration under AAA Consumer Rules in Loudoun County, Virginia.

You waive the right to a jury trial and to participate in class actions.

16. Modifications

We may update these Terms from time to time. Continued use of the Services constitutes acceptance of the revised Terms.
